Trial Date Approaching for Portola Packaging Patent Infringement Claims Against Consumer Cap

SAN JOSE, CALIF. (Feb. 24) BUSINESS WIRE -Feb. 24, 1999--Portola Packaging, Inc., a leading manufacturer of plastic closures, bottles and equipment for the dairy, juice and bottled water industries, has been informed that its patent infringement case against Consumer Cap Corporation has been placed on the March 1999 trial list by a federal judge in Pittsburgh.

The case will be heard in the U.S. District Court For The Western District Of Pennsylvania, Judge Standish presiding.

Portola claims that Consumer Cap infringes Portola's patents relating to a push-on, screw-off, tamper-evident bottle cap that is used widely in the dairy industry. The cap alleged to infringe Portola's patents is called the Alpha Cap by Consumer Cap.

The initial phase of the upcoming trial involves Consumer Cap's liability for patent infringement. Portola has asked the Court to enter a permanent injunction against the further manufacture and sale of the Alpha Cap if Consumer Cap is found liable by the jury after what is expected to be about a ten-day trial.
